- (Adopted at the 1464th meeting of the Judicial Committee of the Supreme People's Court on March 23, 2009; and amended in accordance with the Decision of the Supreme People's Court to Amend 27 Civil Judicial Interpretations Including the Interpretation of the Supreme People's Court on Several Issues Concerning the Applicationof the Trade Union Law of the People's Republic of China in Civil Trials adopted at the 1823th meeting of the Judicial Committee of the Supreme People's Court on December 23, 2020)
- (2009年3月23日最高人民法院审判委员会第1464次会议通过,根据2020年12月23日最高人民法院审判委员会第1823次会议通过的《最高人民法院关于修改〈最高人民法院关于在民事审判工作中适用《中华人民共和国工会法》若干问题的解释〉等二十七件民事类司法解释的决定》修正)
- For the purposes of correctly trying disputes over separate ownership in a building and protecting the lawful rights and interests of the parties, this Interpretation is formulated according to the Civil Code of the People's Republic of China and other laws, in light of the practice of civil trial.
- 为正确审理建筑物区分所有权纠纷案件,依法保护当事人的合法权益,根据《中华人民共和国民法典》等法律的规定,结合民事审判实践,制定本解释。
- Article 1 A person who acquires ownership of a private portion of a building by registration or under Articles 229 through 231 of the Civil Code shall be deemed to be an owner as mentioned in Chapter VI of Book Two of the Civil Code.
- 第一条 依法登记取得或者依据民法典第二百二十九条至第二百三十一条规定取得建筑物专有部分所有权的人,应当认定为民法典第二编第六章所称的业主。
