国家外汇管理局关于废止和失效5件外汇管理规范性文件及7件外汇管理规范性文件条款的通知

The branches and foreign exchange administrative departments of the State Administration of Foreign Exchange (“SAFE”) in all provinces, autonomous regions, and municipalities directly under the Central Government; branches of the SAFE in Shenzhen, Dalian, Qingdao, Xiamen, and Ningbo; and all national Chinese-Funded banks:
国家外汇管理局各省、自治区、直辖市分局、外汇管理部，深圳、大连、青岛、厦门、宁波市分局，各全国性中资银行：

For purposes of advancing the reform of “simplifying procedures, decentralizing powers, combining decentralization with appropriate control, and optimizing services” in foreign exchange administration as well as making it easier for market participants to understand and adopt the provisions on foreign exchange administration, you are hereby notified of the effectiveness of certain regulatory documents on foreign exchange administration or their clauses as follows:
为推进外汇管理“放管服”改革，便利市场主体了解执行外汇管理规定，现就部分外汇管理规范性文件或条款的效力通知如下：

I. Two regulatory documents on foreign exchange administration shall be repealed, because the main provisions of them have been replaced with new regulatory documents, and they are no longer consistent with the actual circumstance of current administration (See Annex 1 for the list).
　　一、对主要内容被新文件代替、与当前管理实际不符的2件外汇管理规范性文件，予以废止。目录见附件1。

II. Three regulatory documents on foreign exchange administration shall be invalidated upon announcement, because they have become actually invalid as a result of the expiry of the applicable periods of them or disappearance of the regulated subject matters of them (See Annex 2 for the list).
　　二、对适用期已过或者调整对象已经消失，实际上已经失效的3件外汇管理规范性文件，宣布失效。目录见附件2。

III. Some clauses of seven regulatory documents on foreign exchange administration shall be repealed or amended (See Annex 3 for the list).
　　三、对7件外汇管理规范性文件中的部分条款予以废止或修改。目录见附件3。
