最高人民法院关于审理道路交通事故损害赔偿案件适用法律若干问题的解释

(Interpretation No. 19 [2012] of the Supreme People's Court, adopted at the 1556th session of the Judicial Committee of the Supreme People's Court on September 17, 2012)

For the purpose of correctly trying the cases on compensation for damage in road traffic accidents, this Interpretation is hereby formulated in accordance with the Tort Law of the People's Republic of China, the Contract Law of the People's Republic of China, the Road Traffic Safety Law of the People's Republic of China, the Insurance Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China and other laws, and taking the judicial practice into consideration.
为正确审理道路交通事故损害赔偿案件，根据《中华人民共和国侵权责任法》《中华人民共和国合同法》《中华人民共和国道路交通安全法》《中华人民共和国保险法》《中华人民共和国民事诉讼法》等法律的规定，结合审判实践，制定本解释。
