- The right of a real property buyer to preclude the enforcement of a monetary claim is specified in Article 28 of the Provisions of the Supreme People's Court on Several Issues Concerning the Handling of Objection to Enforcement and Reconsideration Cases by People's Courts, while the right of a consumer buyer of house to preclude the enforcement of a monetary claim is specified in Article 29. Where a non-party claims preclusion of enforcement with respect to a commodity housing registered in the name of a real estate development enterprise which is the person subject to enforcement, either Article 28 or Article 29 may apply; and if the non-party claims the application of Article 28, the people's court shall conduct an examination.
- 《最高人民法院关于人民法院办理执行异议和复议案件若干问题的规定》第二十八条规定了不动产买受人排除金钱债权执行的权利,第二十九条规定了消费者购房人排除金钱债权执行的权利。案外人对登记在被执行的房地产开发企业名下的商品房请求排除强制执行的,可以选择适用第二十八条或者第二十九条规定;案外人主张适用第二十八条规定的,人民法院应予审查。
