  • The people's courts shall take into account whether the relevant advertising slogan are ambiguous, whether they are prone to result in misunderstandings among the relevant members of the public, whether the actor is at fault for false publicity, and other factors in determining whether advertising constitutes the act of false publicity under the Anti-unfair Competition Law. Where a party publishes the advertising slogan involved in the case, based on the historical relationship of the trademark license contract between the parties, its contribution to improving the goodwill of the relevant trademark, and other factors, to inform consumers of basic facts according to the objective situation, and neither creates a possibility of easily resulting in misunderstandings among the relevant members of the public nor is at fault for improper appropriation of the visibility and goodwill of the relevant trademark, the party commits no act of false publicity under the Anti-unfair Competition Law.
  • 人民法院认定广告是否构成反不正当竞争法规定的虚假宣传行为,应结合相关广告语的内容是否有歧义,是否易使相关公众产生误解以及行为人是否有虚假宣传的过错等因素判断。一方当事人基于双方曾经的商标使用许可合同关系以及自身为提升相关商标商誉所做出的贡献等因素,发布涉案广告语,告知消费者基本事实,符合客观情况,不存在易使相关公众误解的可能,也不存在不正当地占用相关商标的知名度和良好商誉的过错,不构成反不正当竞争法规定的虚假宣传行为。
