  • 1. In an application for the establishment of the fund for limitation of liability for maritime claims, a people's court shall conduct a procedural review only on the qualification of the applicant, the nature of claims involved in the accident, and the amount of that fund to be established. Such problems as whether the applicant in substantiality shall enjoy the limitation of liability for maritime claims and whether there are other claims not subject to limitation co-existing with the claims subject to limitation involved in the accident do not affect the court's ruling on approving the establishment of the fund for limitation of liability for maritime claims.
  • ⒈ 对于申请设立海事赔偿责任限制基金的,法院仅就申请人主体资格、事故所涉及的债权性质和申请设立基金的数额进行程序性审查。有关申请人实体上应否享有海事赔偿责任限制,以及事故所涉债权除限制性债权外是否同时存在其他非限制性债权等问题,不影响法院依法作出准予设立海事赔偿责任限制基金的裁定。

The “ship engaging in shipping between ports of the People's Republic of China” as mentioned in paragraph 2, Article 210 of the Maritime Law of the People's Republic of China shall be interpreted as a ship that is engaging in shipping between ports of the People's Republic of China in the voyage in which an accident occurs.
  • ⒉《中华人民共和国海商法》第二百一十条第二款规定的“从事中华人民共和国港口之间的运输的船舶”,应理解为发生海事事故航次正在从事中华人民共和国港口之间运输的船舶。
