- 编造虚假恐怖信息罪 严重扰乱社会秩序
- To determine whether the making of a false terrorist threat “has seriously disturbed the social order,” factors such as the impacts of it on the normal order of working, production, lives, trade, teaching, and scientific research, the panic caused among the public, and the intervention implemented should be fully analyzed and judged. The act of making or intentionally spreading a false terrorist threat to the safety of civil aviation, which caused panic among the public or the failure of scheduled flights to take off or land, should be determined as an act that “has seriously disturbed the social order.”
- 关于编造虚假恐怖信息造成“严重扰乱社会秩序”的认定，应当结合行为对正常的工作、生产、生活、经营、教学、科研等秩序的影响程度、对公众造成的恐慌程度以及处置情况等因素进行综合分析判断。对于编造、故意传播虚假恐怖信息威胁民航安全，引起公众恐慌，或者致使航班无法正常起降的，应当认定为“严重扰乱社会秩序”。
