- Where an information network is used to defame other persons, undermine the public security, and seriously disrupt social order on the network complies with "seriously undermine social order" as provided in paragraph 2 of Article 246 of the Criminal Law, the procuratorial organ shall perform its prosecuting duties in accordance with the law and handle the case as a public prosecution case. Where the public security organ has not filed a case for investigation, and the victim has filed a private prosecution, the procuratorial organ shall effectively handle the conversion of the private prosecution to a public prosecution procedure.
- 利用信息网络诽谤他人，破坏公众安全感，严重扰乱网络社会秩序，符合刑法第二百四十六条第二款“严重危害社会秩序”的，检察机关应当依法履行追诉职责，作为公诉案件办理。对公安机关未立案侦查，被害人已提出自诉的，检察机关应当处理好由自诉向公诉程序的转换。
